Understanding the processing times for various employment-based immigration categories is crucial for applicants. Below, we’ve compiled average processing times for the EB-1, EB-2, EB-2 National Interest Waiver (NIW), and EB-5 categories at both the Texas and Nebraska Service Centers. Please note that these are approximate durations and can vary based on individual circumstances and USCIS workloads.

EB-1 Visa Processing Times:

  • Texas Service Center: Approximately 23 months.
  • Nebraska Service Center: Approximately 21.5 months.

Note: The EB-1 category includes subcategories such as EB-1A (Extraordinary Ability), EB-1B (Outstanding Professors and Researchers), and EB-1C (Multinational Managers or Executives). Processing times may vary slightly between these subcategories.

EB-2 Visa Processing Times:

  • Texas Service Center: Approximately 8 months.
  • Nebraska Service Center: Approximately 8 months.

Note: The EB-2 category requires a PERM Labor Certification, which can add approximately 10 months to the overall processing time, including prevailing wage determination and recruitment processes.

EB-2 NIW (National Interest Waiver) Processing Times:

  • Texas Service Center: Approximately 13 months.
  • Nebraska Service Center: Approximately 13 months.

Note: The NIW allows applicants to bypass the PERM Labor Certification, potentially reducing the overall processing time.

EB-5 Visa Processing Times:

  • Texas Service Center: Processing times can vary; applicants are advised to consult the USCIS website for the most current information.
  • Nebraska Service Center: Processing times can vary; applicants are advised to consult the USCIS website for the most current information.

Note: The EB-5 Immigrant Investor Program processing times can fluctuate based on factors such as visa availability and project-specific considerations.

E-2 Visa Processing Times

The processing time for an E-2 Investor Visa depends on whether the application is submitted through consular processing (outside the U.S.) or a change of status (within the U.S.).

Processing Times by Application Type

  • Consular Processing (Applying from Outside the U.S.): A few weeks to several months, depending on the U.S. embassy’s workload.
  • Premium Processing (USCIS Expedited Service): 15 calendar days for an additional fee of $2,805.

Additional Considerations

  • Processing times vary based on country-specific procedures and embassy interview availability.
  • Applicants should allow extra time for document preparation, business structuring, and financial verification before submission.
  • Visa renewal processing may be quicker if business operations remain compliant with E-2 visa requirements.

Disclaimer: The processing times provided above are average estimates based on observations and publicly available information as of February 2025. Actual processing durations may vary depending on individual case specifics, USCIS workload, and policy changes.
